Terms Of Services

This agreement covers the provision of the "services" by DentOp (“DentOp, "us", "our" or "we") to you as an individual ("you" or "your"). Your use of the services will be governed by this agreement, along with DentOp’s privacy policy. Please read this agreement carefully before you use any DentOp services. By using our services, you agree to become bound by the terms and conditions of this agreement.

Accounts

When you set up an account for using our service you may be asked to create a password. You are responsible for choosing an appropriate password and for keeping it secure. DentOp will not ask you for your password and you should not reveal it to anyone. The password would be used for your future logins to access your records with DentOp or to avail DentOp services. You may cancel your account at any time on the DentOp website. We will not charge a fee for cancelling your DentOp account. Once the account is cancelled, all your records with DentOp would also be deleted, and can’t be accessed in the future even if you make another account with us.

Fees and payment

The DentOp services consist of consultations. If you purchase opinion from us, payment for the opinion is due at the time you purchase it. You will be asked to enter your card details and we will charge your card at the time of purchase. Payment for services is handled for DentOp by a third party. All fees are non-refundable. You are responsible for any foreign transaction fees incurred by your bank. Service needs to be availed within one week of making the payment, as per the appointment scheduled. If you fail to schedule an appointment, or aren’t present for the appointment and haven’t cancelled it either, DentOp isn’t liable and there shall be no refund. If the consultation isn’t provided within the stipulated time by DentOp, despite the patient scheduling an appointment and being present, DentOp’s will give 100% refund to the patient. Refunds would be given only in case of inability to provide consultations from DentOp within the stipulated/ scheduled time. If you wish to cease the provision of the paid services, you may do so by cancelling your account. If you cancel prior to the effective date of any increase in the price of the service, you will not be charged the higher fees.

Acceptable use and conduct

All usage of the services must be legal and not infringe rights. You must not take any action or use the services in any way that might bring DentOp into disrepute, affect the ability of DentOp to provide the services, be illegal, or encourage illegal activities. You may not use the services in any manner that might be libelous or defamatory, that contains threats or incites violence towards individuals or entities, or that violates the privacy or publicity rights of any third party. We may limit the response to patient questions at our discretion, where reasonably required from time to time. Some services have usage limitations, and you may not exceed these. You shall indemnify DentOp in full for any loss, cost or damages suffered by it as a result of your use or misuse of the services.

Intellectual property

You acknowledge that all intellectual property in the DentOp website provided as part of the services, belongs to DentOp. You will not acquire any rights to the intellectual property from your use of the services, other than you can use the opinion provided as per your requirement.

Collection and use of your data

We may collect certain non-personally-identifiable information, provided by you during the consultation process. The information collected may include all the data filled-in by you the forms which will be required for providing the dental opinion. You agree this information may be retained and used DentOp. DentOp may disclose any or all personal data and contents you have sent, posted or published if required, to comply with applicable law or the order or requirement of a court, administrative agency or other governmental body. The customer data will be saved securely at our end. The data would be secured by sign in and other than the patient and the consulting doctor nobody else would have access to the records.

Consultation Services

The consultation would be given in the best of our knowledge based on the information given by you. Opinions can vary and are subjective. The patient is advised to use their personal discretion about choosing the treatment plan they want to undergo. DentOp is not liable for any treatment suggested. In certain cases, medicines might be required to treat the underlying condition. We will be sending a prescription with required medicines, the dosage, name and registration number of the prescribing doctor, and date the prescription is issued, the prescription needs to be filled in within 48 hours of being prescribed, else we shall not be liable for the effects. The service is based out of India. Although we do look forward to extending and sharing our expertise with people around the world the application of the opinion and prescription might be limited, complying to the law of the country you are residing in.

Termination

We look forward to providing you with services for so long as you wish to have them. However, there are some circumstances under which the service may be terminated.

• 1. We may cease to offer the services for any reason, in which case we will provide you with notice (via email). In this event, we will not charge you for services and will refund any fees paid in advance for services that have not been received.
• 2. DentOp may remove any information or suspend or terminate your use of the services at any time if DentOp is made aware that you are in breach of any term of this agreement or you are using the services for any activity that may be illegal.

Changes to the services or this agreement

We aim to continually improve the delivery and content of the services and, as a result, will make changes to services from time to time. New features will be continually added, but we also may modify or discontinue (temporarily or permanently) a service, in part or in whole. We may also offer services on a trial basis, in which case your use of those services will be limited to the period of your trial and subject to the terms of the trial. What constitutes a material change in this circumstance will be determined by DentOp, in good faith and using common sense and reasonable judgment. Similarly, we may occasionally change the terms of this agreement. If DentOp does change the terms of this agreement, all changes will go into effect at the time we post the updated agreement.

Additional terms and payment

Some services or content may be subject to additional terms or may require payment of additional fees. In that event, you will be given an opportunity to review and agree to such terms and fees before using those services or accessing such content.

Limitation of Liability

Services provided under this agreement are provided to you as is and with no warranties whatsoever. All implied warranties are excluded to the extent legally permissible. DentOp will provide the services using reasonable skill and care. Under no circumstances will DentOp be liable to you for any consequential or indirect loss of profits or economic advantage. DentOp will use reasonable efforts to ensure availability of the services, but makes no guarantee that the services will be available without interruption. DentOp is not responsible for the loss of any of any form as a consequence of your use of the services. These limitations of liability do not apply with respect to any death or personal injury as a consequence of the negligent act of DentOp, its employees.
